Validation of European Patents in Spain
Validation of European Patents in Spain
What’s the validation of a European patent in Spain?
The granting of a European patent by the European Patent Office (EPO) provides access to protection in up to 39 countries through a single procedure. However, the granting of a patent does not in itself mean that the patent is automatically protected in all of these countries.
For the patent to have real effect, it is necessary to:
- Validate it in each of the countries where protection is desired, and/or
- Apply for a unitary patent
Why is it necessary to validate the patent in Spain?
Spain is not part of the unitary patent system. Therefore, validation of the European patent is essential to obtain protection in Spain.
If the patent is not validated, there will be no patent rights in the Spanish market.
How do I validate a European patent in Spain?
The validation of a European patent in Spain must be carried out within three months from the publication of the grant and requires compliance with the following procedures:
- Payment of the official fees of the Spanish Patent and Trademark Office (OEPM)
- Submission of a full translation of the patent into Spanish
- Appointment of a legal representative
